These Terms govern your access to and use of our websites, mobile applications, firmware, and connected agricultural equipment (collectively, the “Services”). By using our Services in any jurisdiction (including North America, the European Union, the United Kingdom, and Australia), you agree to comply with these Terms.<\/span><\/p>\n

      To access certain features of our hardware and mobile software, you may be required to register an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify TrolMaster immediately at support@trolmaster.com if you suspect any unauthorized access to your account.<\/span><\/p>\n

      1. Acceptable Use and Restrictions<\/b><\/li>\n<\/ol>\n

        You agree not to:<\/span><\/p>\n

        • Reverse engineer, decompile, or disassemble any hardware, software, or firmware provided by TrolMaster.<\/span><\/li>\n
        • Interfere with or disrupt the security, integrity, or performance of our IoT controllers, sensors, or servers.<\/span><\/li>\n
        • Use TrolMaster products or services for any unlawful purpose or in violation of local agricultural, safety, or environmental laws.<\/span><\/li>\n<\/ul>\n

          1. Intellectual Property Rights<\/b><\/li>\n<\/ol>\n

            All trade secrets, patents, copyrights, trademarks, brand names, software code, and interface designs associated with TrolMaster products belong exclusively to TrolMaster Agro Instruments Co., Ltd. Nothing in these Terms grants you any license or right to use our intellectual property without prior written consent.<\/span><\/p>\n

            1. Third-Party Hardware & Compatibility Disclaimer<\/b><\/li>\n<\/ol>\n

              TROLMASTER DISCLAIMS ANY AND ALL LIABILITY, INCLUDING ANY EXPRESS OR IMPLIED WARRANTIES, WHETHER ORAL OR WRITTEN, FOR THIRD-PARTY HARDWARE. THE CUSTOMER ACKNOWLEDGES THAT TROLMASTER HAS MADE ITS BEST EFFORTS TO MATCH ITS PRODUCTS TO WORK WITH THIRD-PARTY HARDWARE OR THE ABILITY TO CONNECT TO AND CONTROL THIRD-PARTY HARDWARE FOR THE CUSTOMER\u2019S INTENDED PURPOSE. TROLMASTER ADDITIONALLY AND SPECIFICALLY DISCLAIMS ANY AND ALL LIABILITY FOR CHANGES, ADDITIONS, OR UPDATES IN ANY WAY TO A THIRD-PARTY MANUFACTURER’S PRODUCTS.<\/span><\/p>\n

              1. Limitation of Liability<\/b><\/li>\n<\/ol>\n

                TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TROLMASTER SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF CROPS, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR EQUIPMENT FAILURE) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR PRODUCTS OR SERVICES. TROLMASTER’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.<\/span><\/p>\n

                1. Governing Law and Dispute Resolution<\/b><\/li>\n<\/ol>\n

                  • General Jurisdictions:<\/b> These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law rules.<\/span><\/li>\n
                  • EU and UK Consumers:<\/b> Mandatory statutory protections and consumer rights under the laws of your country of residence remain unaffected. You may submit disputes to local consumer mediation bodies or courts as guaranteed by European Union and UK consumer rights regulations.<\/span><\/li>\n<\/ul>\n

                      How Long Does The Coverage Last?<\/b><\/p>\n

                      The product warranty becomes effective from the date of purchase by the original purchaser. Coverage terminates if you sell or otherwise transfer the product. The repair or replacement of your product under warranty will not extend the period of the warranty.<\/span><\/p>\n

                      • Standard Products:<\/b> Three (3) years warranty on all mechanical and electronic components from the purchase date.<\/span><\/li>\n
                      • Sensor Probes:<\/b> One (1) year warranty from the purchase date.<\/span><\/li>\n<\/ul>\n

                        How Do You Get Service?<\/b><\/p>\n

                        Products are to be returned to the TrolMaster Tech Support Center under your express account. The purchaser is responsible for shipping costs and risk of loss during transit to our service center.<\/span><\/p>\n

                        What Is Covered?<\/b><\/p>\n

                        TrolMaster warrants the mechanical and electronic components of all TrolMaster series to be free of defects in material and workmanship if used under normal operating conditions. We will repair or replace your product if found defective within the warranty period due to defective materials or workmanship existing at the time of purchase (including normal wear and tear). If any part is no longer available or out of manufacture, TrolMaster will replace it with a functionally equivalent replacement part. If TrolMaster decides to replace the entire product, this limited warranty shall apply to the replacement product for the remaining initial warranty period.<\/span><\/p>\n

                        What Is Not Covered?<\/b><\/p>\n

                        TrolMaster shall <\/span>NOT<\/b> be liable for costs of repair or replacement of a product incurred as a result of:<\/span><\/p>\n

                        1. Accidental damage, faults caused by negligent use or care, neglect, careless operation, or handling of the product which is not in accordance with the TrolMaster Instruction Manuals.<\/span><\/li>\n
                        2. Use of parts not assembled or installed in accordance with the instructions of TrolMaster.<\/span><\/li>\n
                        3. Use of parts or accessories other than those produced or recommended by TrolMaster.<\/span><\/li>\n
                        4. External sources such as transit damage, power surges, water submersion, or extreme weather.<\/span><\/li>\n
                        5. Repairs or alterations carried out by parties other than TrolMaster or its authorized agents.<\/span><\/li>\n
                        6. Serial numbers defaced, altered, or missing.<\/span><\/li>\n<\/ol>\n
